The following is a list of cases that are either scheduled to be heard or have already been heard by the Planning Commission, Board of Supervisors, or Board of Zoning Appeals.

PLANNING COMMISSION

08-01-VS.  Kenneth W. Moore Jr. (Powhatan Station/Graceland Electoral District) requests a variance to §6.2-2.0 of the Subdivision Ordinance.  The purpose of the variance is to allow a proposed 3.251 acre family division parcel to access a regulated three (3) lot private road.  The Comprehensive Plan designates the subject property as Low Density Residential (Future Land Use Plan Map) in a Rural Preservation Area (Land Use Policy Map).  The subject property is approximately 13 acres in size and is located on the west side of Dorset Rd. (Rt. 622).  Reference to part of Tax Map Parcel #53-73.
Action:  Approved by the Commission on July 1, 2008.

08-05-PR. Kenneth W. Moore Jr. (Powhatan Station/Graceland Electoral District) requests approval to add a 3.251 acre family division parcel to an existing three lot regulated private road subdivision in the A-1 Agricultural District per §5.3-3.3 and §6.2-2.0 of the Subdivision Ordinance.  The Comprehensive Plan designates the subject property as Low Density Residential (Future Land Use Plan Map) in a Rural Preservation Area (Land Use Policy Map).  The subject property is approximately 13 acres in size and is located on the west side of Dorset Rd. (Rt. 622).  Reference to part of Tax Map Parcel #53-73.
Action:  Approved by the Commission on July 1, 2008.

07-06-REZC. William S. Carnes; Beechwood Inc. (Subletts/Manakin Electoral District) request rezoning of approximately 135 acres from RR Rural Residential to C Commercial with Conditions and RR Rural Residential with Conditions.  The purpose of the request is to allow development of retail and office uses on the subject property.  The Comprehensive Plan designates the subject property as Very Low Density Residential (Future Land Use Plan Map) in a Rural Preservation Area Sub-Area (Land Use Policy Map).  The subject properties are located on the north side of Huguenot Trail (Rt. 711) between Rt. 288 and Winterfield Road (Rt. 714).  Reference to Tax Map Parcels #32-40A and #32-40B.
Action:  Request was withdrawn by the Applicants.

08-01-REZP.  William and Gene DuVal; DuVal Development (Subletts/Manakin Electoral District) request to amend the proffered conditions of Case #04-19-REZC, Upper Meadows Subdivision, currently zoned R-5 Residential with Conditions.  The Comprehensive Plan designates the subject property as Low Density Residential (Future Land Use Plan Map) in a Rural Preservation Area (Land Use Policy Map).  The property is 193 acres in size and located south of Huguenot Trail (Rt. 711) and west of Old Confederate Cemetery Road (Route 640).  Reference Tax Map Parcel #31-36.
Action:  To be heard by the Planning Commission on August 5, 2008.

08-06-CUP.  Kenneth L. & Laura C. Wade (Smith’s Crossroads/Pineville Electoral District) request renewal of a Conditional Use Permit (CUP) for a home-based business in the A-1 Agricultural District per §5.3(4) of the Zoning Ordinance.  The proposed home-based business is truck and farm equipment repairs.  The Comprehensive Plan designates the subject property as Low Density Residential (Future Land Use Plan Map) in a Rural Preservation Area (Land Use Policy Map).  The subject property is 22.108 acres in size and is located at 3719 Jefferson Landing Road.  Reference to Tax Map Parcel #7-18D.
Action:  To be heard by the Planning Commission on August 5, 2008.

08-07-CUP.  Daniel & Amy Conrad; Phyllis Ashford (Smith’s Crossroads/Pineville Electoral District)
request a Conditional Use Permit for an accessory apartment in the
R-2 Residential District per §10.9(6) of the Zoning Ordinance.  The Comprehensive Plan designates the subject property as Low Density Residential (Future Land Use Plan Map) in a Rural Preservation Area (Land Use Policy Map).  The subject property is approximately 5.578 acres in size and is located at 3530 Timberview Road.  Reference to Tax Map Parcel #16(2)(B)21.
Action:  To be heard by the Planning Commission on August 5, 2008.

08-08-CUP.  Diane & Michael Roper (Powhatan Courthouse/Ballsville Electoral District)
request renewal of a conditional use permit (CUP) for a second dwelling unit on a lot per §5.3(18)(b) of the Zoning Ordinance.  The Comprehensive Plan designates the subject property as Low Density Residential (Future Land Use Plan Map) in a Rural Preservation Area (Land Use Policy Map).  The subject property is 6.146 acres in size and is located at 6528 Blenheim Road.  Reference Tax Map Parcel #34(1)16.
Action:  To be heard by the Planning Commission on August 5, 2008.


BOARD OF SUPERVISORS

07-04-REZC, Donald & Teresa Sanders, Stephen P. Lindberg/Dean Patrick, Patrick Construction (Powhatan Courthouse/Ballsville Electoral District) request the rezoning of 171.86 acres in three parcels from A-1 Agricultural to R-5 Residential with Conditions.  The purpose of the request is to create a single family residential subdivision with a maximum of 34 lots regardless of size.  Average lot sizes will be five (5) acres, but the zoning ordinance also allows lots to be as small as two (2) acres.  Residential density in the Rural Preservation Area should be one (1) dwelling per five (5) acres.  The Comprehensive Plan designates the subject property as Low Density Residential (Future Land Use Plan Map) in a Rural Preservation Area (Land Use Policy Map).  The subject properties are located on the south side of Anderson Highway (US 60) between Old Tavern Road and Ballsville Road.  A portion of the subject properties also fronts on the west side of Old Tavern Road between Anderson Highway and Old Buckingham Road.  Reference to Tax Map Parcels #23-48, 23-50F, and part of 24-9F.
Action:  To be heard by the Board of Supervisors on August 11, 2008.

07-05-REZC, Ronald H. Oliver, Jr. (Powhatan Courthouse/Ballsville Electoral District) requests the rezoning of a one (1) acre parcel from R-C Residential Commercial to I-1 Light Industrial with Conditions, and the rezoning of 1.63 acres of a 5.45 acre split-zoned parcel from R-C Residential Commercial and I-1 Light Industrial with Conditions to I-1 Light Industrial with Conditions.  The purpose of the request is to permit construction of a warehouse to serve an existing industrial use on an adjoining parcel.  The Comprehensive Plan designates the subject properties as Village Mixed Use (Future Land Use Plan Map) in a Village Preservation Area (Land Use Policy Map).  The subject properties are located at 4347 and 4353 Anderson Highway.  Reference to Tax Map Parcels #26(4)2 and part of
#26(4)3.
Action:  Deferred at the Applicant's request by the Board for two months to the August 11, 2008 meeting.  Planning Commission voted to recommend approval of the request at their January 8, 2008 meeting.

08-05-CUP.  Timothy G. & Lisa L. Benusa/Le Moulin, LLC (Bethesda Electoral District) request renewal of a Conditional Use Permit (CUP) to operate a facility for weddings/meetings/special events in the A-1 Agricultural District per §5.3(2) of the Zoning Ordinance.  The renewal includes a request for the CUP to be issued with no expiration date and to allow the maximum number of guests allowed without traffic control personnel to be increased from 75 to 100.  The use is located on a 10.69 acre parcel at 2434 Robert E. Lee Road. The subject property is designated as Very Low Density Residential (Future Land Use Plan Map) in a Rural Preservation Area Sub-Area (Land Use Policy Map).  Reference Tax Map Parcel #18-30A.
Action:  Approved by the Board of Supervisors on July 21, 2008.


BOARD OF ZONING APPEALS (BZA)

08-08-VZ.  Ballast LLC; James R. Sowers Jr. (Powhatan Courthouse/Ballsville Electoral District) request the following variances to the fifty (50) foot buffer required
per §27.6(1)(a)(iii) of the Zoning Ordinance – twenty (20) feet on the front and rear property lines, thirty-five (35) and forty (40) feet on the south side property line, and twenty-five (25) feet on the north side property line. The purpose of the variance request is to construct a commercial building on the subject property with required parking areas. The property is zoned C Commercial, is 1.700 acres in size, and is located on the east side of Old Buckingham Road (Route 13). Reference to Tax Map Parcel # 26B3-(1)-18. 
Action:  To be heard by the BZA on August 14, 2008.

08-09-VZ.  Gallier Meyer Properties LLC (Powhatan Station/Graceland Electoral District) request a variance of twenty-five (25) feet from the required fifty (50) foot front parking setback, and a variance of ten (10) feet on both the side and rear property lines from the required ten (10) foot parking setback per §26.3(7) of the Zoning Ordinance.   The purpose of the variance request is to construct commercial buildings with required parking areas on the parcel . The property is zoned C Commercial, is 3.472 acres in size, and is located on the east side of Standing Ridge Drive in Oakbridge Industrial Park. Reference to Tax Map Parcel #43C-4-2.
Action:  To be heard by the BZA on August 14, 2008.
