PUBLIC HEARINGS
D. 08-05-CUP. Timothy G. & Lisa L. Benusa/Le Moulin, LLC (Bethesda Electoral District) request renewal of a Conditional Use Permit (CUP) to operate a facility for weddings/meetings/special events in the A-1 Agricultural District per §5.3(2) of the Zoning Ordinance. The renewal includes a request for the CUP to be issued with no expiration date and to allow the maximum number of guests allowed without traffic control personnel to be increased from 75 to 100. The use is located on a 10.69 acre parcel at 2434 Robert E. Lee Road. The subject property is designated as Very Low Density Residential (Future Land Use Plan Map) in a Rural Preservation Area Sub- (Land Use Policy Map). Reference Tax Map Parcel #18-30A.
E. 06-04-AZ.An Ordinance to amend §25.14, Buffers Along Streams, and Article 44, Definitions, of the Powhatan County Zoning Ordinance. The purpose of the amendment is to add language to require buffers and additional setbacks from jurisdictional wetlands, and to define the term “wetlands.” Specifically, the amendment would require a 50 foot buffer to be maintained from all jurisdictional wetlands that are contiguous to intermittent and perennial streams, and an additional 25 foot building setback to be measured from the terminus of any stream or wetland buffer. The amendment would also allow best management practices to be substituted for stream and wetland buffers, but would not allow buffers to be reduced by more than 50%. Signage requirements and provision for roads, driveways, and utilities to cross buffers are also included in the amendment.
F. 06-06-AS. An Ordinance to amend §4.2-2.12, Other Conditions, of the Powhatan County Subdivision Ordinance. The purpose of the amendment is to add language to require wetland buffers and additional setbacks from jurisdictional wetlands to be shown on preliminary subdivision plats and, by reference, on final subdivision plats per §4.4-2.11.
G. 08-01-AS. An Ordinance to amend Article 6, General Design Requirements, of the Powhatan County Subdivision Ordinance. The amendments place additional requirements on the construction and approval of private roads including requiring construction certification by a licensed professional engineer, limiting all private roads including family private roads to serve a maximum of ten (10) lots, basing road design standards on the aggregate number of lots to be served, and requiring additional performance guarantees for one year after completion of private road construction for maintenance purposes, among other proposed changes. This amendment was advertised for public hearing on September 12, 2005 but was not acted on by the Board of Supervisors.

The Board of Supervisors of Powhatan County will meet on Monday, July 21, 2008, at 7:00 PM in the Powhatan County High School Auditorium, 1800 Judes Ferry Road, to consider the following requests:

The Zoning Ordinance does not currently impose buffer or setback requirements from jurisdictional wetlands, and does not define the term “wetlands.” This amendment was advertised for public hearing on February 8, 2007 but was not acted on by the Board of Supervisors.
